Rivers “Good Causes Program” Terms and Conditions
1. Introduction
§
This
document sets out the terms and conditions which govern the Good Causes Program
provided by Rivers. These terms and conditions are intended to protect you and
Rivers.
§
These
terms and conditions apply to Members of the Good Causes Program.
§
You
must read this document carefully before you apply to become a Member of the
Rivers Good Causes Program. If you do not understand these terms and conditions,
or if you have any questions, please email goodcauses@rivaus.com.au and we will
be happy to help you.
2. Definitions
In these terms and conditions:
§
“Application
Form” means the online application form required to be completed by an organisation
to apply to become a Member.
§
“Gift Voucher” means any voucher purchased from
Rivers by a Member through the Good Causes Program at a discount of ten (10) percent of
the dollar value of the voucher, or such other discount as determined by Rivers
in its sole discretion.
§
“Member”
means an organisation that is registered in the Rivers Good Causes Program.
§
“Rivers”
means Rivers (

“Terms
and conditions” means these terms and conditions as amended from time to
time.
§
“You”
or “Your” is a reference to your organisation.
3. Participation and Membership
§
Membership
of the Rivers Good Causes Program is open only to organisations in

Organisations
can apply for membership of the Rivers Good Causes
Program by completing an Application Form available on the Rivers website –
www.rivers.com.au. An organisation can hold only one membership of the
Rivers Good Causes Program at any one time.
§
Rivers’ privacy policy is
available for viewing at the following URL: http://www.rivers.com.au/privacy.htm.
§
An organisation must have three (3) registered officials in order to become a Member.
§
These
terms and conditions are deemed to have been accepted and will be binding on an
organisation upon completion and submission of an Application Form.
§
If
your organisation is accepted for membership of the Rivers Good Causes Program,
Rivers may publish the name and logo of your organisation on its website and in
its advertising and marketing material should it choose to do so.
§
For
a period of thirty (30) days after successful registration as a Member, each Member
is entitled to submit one order to Rivers for the purchase of Gift Vouchers. At
the conclusion of the thirty (30) day period, the Member’s membership will
cease.
§
Upon
deactivation, an organisation may re-apply to become a Member of the Good Causes
Program by completing the registration process again in accordance with this clause
3.
§
Membership
may be cancelled/refused by Rivers in its sole discretion at any time if any membership
is deemed by Rivers to be fraudulent or linked to a fraudulent membership. In
this case, all Gift Vouchers owing to or purchased by a Member will be
cancelled.
§
Members
are solely responsible for the use of Gift Vouchers once purchased from Rivers
through the Good Causes Program.
§
Members
are solely responsible for ensuring that they comply with all State and Territory
legislation relating to fundraising and trade promotions (where applicable).
§
Rivers
is not responsible for any unauthorised activity in a Member’s “Good Causes”
account and any order placed through your account will bind you. You must treat
any logon ID, password or other identifiers associated with your account as
confidential.
4. Buying Gift Vouchers
§
Members
can purchase Rivers Gift Vouchers to use in fundraising and associated activities.
§
In
order to purchase Gift Vouchers, Members must fill in the Gift Voucher order form
through the “Good Causes” link on the Rivers website – www.rivers.com.au. An order for Gift
Vouchers must specify the requested dollar value of each Gift Voucher and the
number of Gift Vouchers ordered by the Member
§
Once
a Member has completed all relevant fields of the online Gift Voucher order
form, the Member must print the order form and either fax or mail the completed
order form to the Rivers Online Shop at the address noted on the order form.
§
Rivers
will only accept orders for Gift Vouchers submitted via the Gift Voucher order
form available on the Rivers website. Any order that is not submitted via this
form is ineligible. Rivers accepts no responsibility for any
late, lost, incomplete, misdirected or illegible orders, or for any problems or
technical malfunction in submitting any Gift Voucher order form.
§
Gift
Vouchers will only be issued to Members once full payment for the Gift Vouchers
has been received and processed by Rivers. Rivers will mail the Gift Vouchers
to Members. Gift Vouchers paid for by cheque will not be issued by Rivers to
the Member until the cheque clears. This may take up to 20 days. Rivers is not
liable for any delay in issuing Gift Vouchers.
§
Rivers
will not be responsible for any loss of or damage to Gift Vouchers in transit.
§ No cancellations of orders are possible after the processing of payment.
§
Any Gift Voucher purchased by a Member is not eligible to earn Rivers
Frequent Shopper points.
§
Rivers
may, in its discretion, accept or reject any order for Gift Vouchers.
5. Return of Goods
§
There is no refund available on any Gift Vouchers purchased
by a Member as part of the Rivers Good Causes Program (unless where applicable
under the Trade Practices Act 1974 or equivalent State or Territory legislation).
§
There is no refund available on any products purchased
using any Gift Voucher acquired by a Member as part of the Rivers Good Causes Program
(unless where applicable under the Trade Practices Act 1974 or equivalent State
or Territory legislation).
§
Rivers may at its sole discretion offer either an
exchange for alternate goods or a credit note for the face value of a Gift Voucher.
6. Termination and Transfer
§
Rivers
reserves the right to suspend or terminate a Member’s participation in the Good
Causes Program, if Rivers believes that:
o
any
officer, employee, agent or supporter of the Member’s organisation has acted
inconsistently with these terms and conditions; or
o
any
officer, employee, agent or supporter of the Member’s organisation has engaged
or may engage in fraudulent conduct, or conduct suspected to be fraudulent.
§
Rivers
may, in its sole discretion, cancel all or any Good Causes Gift Vouchers that
have been issued to a Member if that Member’s right to participate in the Good
Causes Program is suspended or terminated.
7. General Information
§
Rivers is not responsible for, and will not replace any lost or stolen Gift
Vouchers.
§
Redemption of Gift Vouchers is subject to Rivers’ standard terms and
conditions.
§
Rivers
reserves the right to suspend or terminate the Rivers Good Causes Program at
any time in its discretion by giving Members at least 30 days prior written
notice. If Rivers suspends or terminates the Good Causes Program, Members are
entitled to receive all Gift Vouchers that they have purchased in the period up
to and including the date of termination.
§
Members
must advise Rivers of any change of name, address or other details as soon as
the change occurs.
§
Rivers
reserves the right at all times to make any changes to these Rivers Good Causes
terms and conditions, including any discount offered, at its sole discretion.
Changes to the terms and conditions may include, but are not limited to changes
to rules governing;
o
the
purchase of Gift Vouchers; and
o
any
discount offered.
§
Rivers
will not be liable for any loss (including, without limitation, indirect,
special or consequential loss or loss of profits), expense, damage, personal
injury or death which is suffered or sustained (whether or not arising from any
person’s negligence) in connection with the Good Causes Program, including with
respect to the use or redemption of any Gift Voucher by any person, except for
any liability which cannot be excluded by law (in which case that liability is
limited to the minimum allowable by law).
§
Rivers
will give Members at least 15 days prior notice, via the Rivers website, of any
material changes to these terms and conditions.
§
Your
rights under these terms and conditions cannot be sold, transferred or assigned
except in accordance with these terms and conditions.
